Throughout the site, the terms “we”, “us” and “our” refer to The Frosali Group SL, operating under the brand soul dept.

These Terms of Service (“Terms”) apply to your access to and use of www.souldept.co, including purchases made through our online store and any related services we provide.

Our store is hosted by Shopify, which provides the e-commerce platform that enables us to sell our products to you.

By accessing our website or purchasing from us, you agree to these Terms as well as any policies referenced herein, including our Privacy Policy, Shipping Policy and Refund & Return Policy.

Nothing in these Terms limits any mandatory consumer rights you may have under applicable law.

2. Online Store Terms

By using our Services, you confirm that you have the legal capacity required to enter into a contract under the laws applicable to you.

You may not use our website, products or Services for any illegal or unauthorised purpose.

You must not transmit viruses, malware or other malicious or destructive code through our website.

We reserve the right to restrict or terminate access to our Services where these Terms are materially violated, subject to applicable law.

3. Products & Made-to-Order Production

Most soul dept. products are made-to-order.

This means that products are generally produced after your order has been placed rather than being held as pre-produced inventory.

Our made-to-order model allows us to produce according to actual demand and helps reduce unnecessary inventory and overproduction.

We make reasonable efforts to display our products, colours, designs, measurements and descriptions as accurately as possible. However, colours may appear slightly different depending on your device, screen settings and the characteristics of the materials and production process.

Minor variations that are inherent to textile and embroidery or printing production may occur.

We reserve the right to modify or discontinue products and to change product descriptions or prices at any time. Such changes will not affect orders that have already been accepted, except where required or permitted by law.

4. Production & Fulfilment by Printful

We work with Printful, a third-party print-on-demand production and fulfilment provider, to manufacture, pack and ship our products on our behalf.

Depending on the product, delivery destination, availability and production capacity, your order may be produced and shipped from different Printful fulfilment locations.

As a result, products do not necessarily ship from Spain.

Products within the same order may occasionally be fulfilled from different locations and delivered in separate packages.

The use of Printful or another fulfilment provider does not change the identity of the seller.

Your purchase is made from The Frosali Group SL / soul dept., not Printful. We remain responsible for our obligations to you as the seller in accordance with applicable law.

5. Pricing & Payments

Unless otherwise stated, prices displayed on our website are in EUR.

VAT is included where applicable.

Shipping costs are calculated during checkout and displayed before you complete your purchase.

Depending on the destination, international orders may be subject to customs duties, import taxes or other charges imposed by local authorities.

Where such charges are not included or collected during checkout, they may be payable by the recipient in accordance with the laws of the destination country.

We use third-party payment providers, including payment methods made available through Shopify. Available payment options will be displayed at checkout.

By submitting an order, you agree to pay the total amount displayed at checkout.

6. Orders

After placing an order, you will receive an electronic confirmation.

We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of:

  • Suspected fraud or unauthorised payment

  • Incorrect pricing or obvious technical errors

  • Product or production unavailability

  • Shipping restrictions

  • Regulatory restrictions

  • Violation of these Terms

If we cancel an order after payment has been received, we will refund the applicable amount using the original payment method unless otherwise agreed.

Please ensure that your order and shipping information is accurate before completing your purchase.

If you notice an error after placing your order, contact us as soon as possible at contact@souldept.co.

Because production may begin shortly after an order is placed, we cannot guarantee that requested order changes or voluntary cancellations can be processed before production begins.

This does not affect any mandatory cancellation or withdrawal rights you may have under applicable consumer law.

7. Shipping & Delivery

Production and shipping are handled on our behalf by our fulfilment and logistics partners.

Current estimated production times, shipping times, destinations, tracking information and other delivery details can be found in our Shipping Policy.

Once your order has been produced and is ready to ship, you will receive a shipping confirmation email with a tracking link, where tracking is available.

Delivery dates and production times provided through our website are estimates unless expressly stated otherwise.

Delays may occur due to production capacity, shipping carriers, customs procedures, weather, regulatory restrictions or other circumstances outside our reasonable control.

Nothing in this section limits your statutory rights in relation to delayed or undelivered goods.

8. Returns, Refunds & Right of Withdrawal

Returns, refunds, cancellations and defective products are governed by our Refund & Return Policy and applicable consumer protection law.

Where you have a statutory right of withdrawal, including where applicable under EU consumer law, the fact that an item is produced on demand does not by itself eliminate that right.

A different rule may apply to products that are genuinely personalised or made according to an individual customer's specifications where the law provides an exception to the right of withdrawal.

Where a statutory right of withdrawal applies, the applicable withdrawal period and conditions will be explained in our Refund & Return Policy.

This does not affect your statutory rights regarding faulty, damaged, defective or incorrectly supplied products.

9. Damaged, Defective or Incorrect Products

If you receive a product that is damaged, defective or different from what you ordered, please contact us at contact@souldept.co and provide your order information and, where appropriate, photographs showing the issue.

We will review the matter and provide an appropriate remedy in accordance with applicable consumer law.

Our use of a third-party production or fulfilment provider does not remove our obligations to you as the seller.

10. Intellectual Property

Unless otherwise stated, the content made available through our website—including our branding, logos, designs, graphics, photographs, product designs, text and other original materials - is owned by or licensed to The Frosali Group SL and is protected by applicable intellectual property laws.

You may access and use our website for your personal, non-commercial use.

You may not reproduce, distribute, commercially exploit, modify or otherwise use our protected materials without our prior written permission, except where permitted by law.

We do not guarantee that our website will always be available, uninterrupted or completely free from technical errors.

These limitations do not affect our responsibilities relating to the products you purchase from us or any other statutory consumer rights.

We will not be responsible for delays or failure to perform our obligations where performance is prevented or materially affected by circumstances outside our reasonable control.
